SECOND APPEAL No.764 of 2010
JUDGMENT:
This Second Appeal is filed by the appellant - appellant - defendant against the judgment and decree dated 31.03.2010 passed in A.S.No.145 of 2008 by the XI Additional Chief Judge - cum- Fast Tract Court: City Civil Court, Hyderabad, confirming the judgment and decree dated 29.11.2007 passed in O.S.No.954 of 2005 by the IX Junior Civil Judge, City Civil Court, Hyderabad.
2. When the matter came up for hearing on 11.09.2023, there was no representation by the learned counsel for the appellant. Accordingly, the matter was directed to be posted to 25.09.2023 under the caption 'for dismissal'. Even today also, there is no representation by the learned counsel for the appellant though the matter is posted under the caption 'for dismissal'. It appears that the appellant is not interested in prosecuting the matter.
3. As the appellant is not evincing any interest in proceeding with the matter, it is considered fit to dismiss the appeal.
4. Hence, the Second Appeal is dismissed for default. No order as to costs.
As a sequel, miscellaneous applications pending in this appeal if any, shall stand closed.
