SECOND APPEAL NO. 1383 OF 2007
JUDGMENT:
Plaintiffs have filed O.S. No.31 of 1991 on the file of Senior Civil Judge, Siddipet, for Mandatory Injunction. The trial Court dismissed the suit. The unsuccessful plaintiffs preferred appeal vide A.S.No.3 of 1999 wherein the appellate Court partly allowed the appeal, against which the second appeal has been filed.
2. A perusal of the docket proceedings shows that the learned counsel for the appellant did not evince any interest to pursue the second appeal proceedings. On 27.04.2022, as there was no representation on behalf of the learned counsel for the appellant, the matter was directed to be listed under the caption 'for dismissal'. Even today also, there is no representation for the appellant. No purpose would be served in continuing the Second Appeal.
3. Accordingly, the Second Appeal is dismissed. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
