JUDGMENT:
This Appeal Suit is filed by the appellant - defendant against the judgment and decree dated 11.03.2019 passed in O.S.No.6 of 2014 by the Senior Civil Judge, Nizamabad.
2. When the matter came up for hearing on 12.09.2023, there was no representation by the learned counsel for the appellant. Accordingly, the matter was directed to be posted to 25.09.2023 under the caption 'for dismissal'. Even today also, there is no representation by the learned counsel for the appellant though the matter is posted under the caption 'for dismissal'. It appears that the appellant is not interested in prosecuting the matter.
3. As the appellant is not evincing any interest in proceeding with the matter, it is considered fit to dismiss the appeal.
4. Hence, the Appeal Suit is dismissed for default. No order as to costs.
As a sequel, miscellaneous applications pending in this appeal if any, shall stand closed.
