WRIT PETITION No.9624 of 2020
ORDER:
The Petitioners in this Writ Petition have questioned the action of respondents in recovering certain amounts from their retirement benefits.
2. Heard both sides and perused the record.
3. The petitioners had worked as Language Pandits and retired from service. Thereafter, when they submitted their pension proposals, the same were returned proposing to recover certain amounts on the ground that the said amounts were paid to them in excess while they were in service, as the orders of Government upgrading their post from Language Pandit Grade-II to Grade-I were withdrawn subsequently.
4. During the course of arguments, learned counsel for the petitioners has submitted that this Writ Petition is covered to be disposed of in terms of the common Order of this Court dated 31.08.2023 passed in W.P.No.13996 of 2021 and batch.
5. Learned Government Pleader has fairly submitted that the subject matter of this Writ Petition is covered by the aforesaid judgment of this Court.
6. In view of the above submissions and for the reasons recorded in the order of this Court dated 31.08.2023 in W.P.No.13996 of 2021 and batch, this Writ Petition is disposed of directing the respondents to re-pay to the petitioners/their legal heirs, the amounts recovered from the retirement benefits of petitioners, within a period of three (03) months from the date of receipt of a copy of this order, under proper acknowledgment. No costs.
Pending miscellaneous applications, if any, shall stand closed.
