JUDGMENT:
This appeal is filed by the appellant-defendant against the judgment dated 29.03.2019 passed in O.S. No.1231 of 2012 by the learned I-Additional Senior Civil Judge, Ranga Reddy at L.B. Nagar.
2. I.A. No.1 of 2019 is filed by the petitioner-appellant to condone the delay of four (4) days in filing the appeal.
3. On 26.09.2019, this Court ordered notice to respondent through Registry and also personal notice by counsel for petitioner in I.A. No.1 of 2019. On 22.10.2019, fresh notice was ordered to the respondent and posted the matter after four weeks. On 01.09.2023 when the matter was taken up, there was no representation by the petitioner-appellant and proof of service of notice on respondent was also not filed. Hence, the matter was directed to be posted to 22.09.2023 under the caption 'for dismissal'. Even today also, there is no representation by the petitioner-appellant.
3. Hence, I.A. No.1 of 2019 is dismissed for default. Consequently, the appeal is also dismissed. No costs. Miscellaneous Applications, pending if any, shall stand closed.
