CRIMINAL APPEAL No.170 OF 2021
JUDGMENT:
This Criminal Appeal is filed by the Appellant/Accused No.2 aggrieved by the conviction recorded by the XVI Additional District & Sessions Judge, R.R.District at Malkajgiri in SC.No.1072 of 2019, dated 23.06.2020, convicting the accused for the offence punishable under Section 392 of the Indian Penal Code and Section 25(1B)(a) of Arms Act, 1959 and sentence of Rigorous Imprisonment for a period of five years and a fine of Rs.100/- for the offence punishable under Section 392 of the Indian Penal Code; sentence of simple imprisonment for a period of one year and a fine of Rs.100/- for the offence punishable under Section 25(1B)(a) of Arms Act, 1959.

3. Learned Counsel appearing for the appellant/A2 would submit that the appellant is in jail from 15.12.2018 and the sentence of imprisonment would be completed by 15.12.2023. He prays, without going into the merits of the case, to reduce the sentence to the period already undergone. 2
4. Keeping in view that the petitioner has already undergone 4 years 9 months of rigorous imprisonment, this Court reduces the sentence of imprisonment to the period already undergone.
5. Accordingly, the Criminal Appeal is partly allowed. The appellant/A2 shall be released forthwith, if he is not required in any other case.
Miscellaneous applications, if any, pending shall stand dismissed.
