On perusal of the proceeding sheet, it depicts that learned counsel for the appellant is no more and that letter addressed to the appellant to that effect was returned unserved with an endorsement 'no such person'. Since long time the appellant is not evincing interest to pursue the matter. Thus, it appears that the appellant is not interested to prosecute the matter vigilantly and diligently anymore. Therefore, this appeal is dismissed for non-prosecution.
