None appeared for the appellant, though the matter was listed today under the caption 'for dismissal'. On perusal of the proceeding sheet, it depicts that on 19.08.2023 though learned counsel for the appellant sought adjournment stating that he want to take steps against the death of the sole appellant, there was no representation for the appellant on 08.09.2023. Thus, it appears that the appellant is not interested to prosecute the matter vigilantly and diligently anymore. Therefore, this appeal is dismissed for non-prosecution.
