HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY
WRIT PETITION No.26266 OF 2023
ORDER: (ORAL)
This writ petition is filed aggrieved by the action of the
respondents in not considering online application No.2200143238
dated 22.11.2022, submitted by the petitioner for passbook data correction in respect of the extent of her land being shown as Ac.1-00 instead of Ac.1-08 guntas in Survey No.894/5/1 situated at Molangur Village, Shankarapatnam Mandal, Karimnagar District, and for deletion of the land admeasuring Ac.0-08 guntas in Survey No.894/5/2, which is shown as 'Government lands' (ceiling patta), from the prohibitory list.
2. It is claimed that the petitioner's father-in-law viz., Muppidi Venkat Reddy had five sons namely Muppidi Madhusdhan Reddy, Muppidi Prabhakar Reddy, Muppidi Dayaker Reddy, Muppidi Sudhakar Reddy and Muppidi Rama Krishna Reddy. The petitioner's husband Muppidi Rama Krishna Reddy died on 30.12.1995 in an accident. After his demise, his three brothers along with his wife (petitioner) and his minor son Muppidi Rahul Reddy instituted a suit in O.S.No.52 of 1987 before the Additional Subordinate Judge, Karimnagar, for partition, and the same was decreed by judgment dated 06.07.1987 allotting the subject land in favour of the petitioner. It is stated that the petitioner was issued pattadar passbook in the year 1995. However, 2 BVR,J W.P.No.26266_2023 some survey numbers were missing in the new pattadar passbook- cum-title deed issued to the petitioner in the year 2018. The petitioner was issued digital passbook in the year 2022, but she was surprised to find that the extent of her agricultural land in Survey No.894/5/1 is shown as Ac.1-00 instead of Ac.1-08 guntas and that an extent of Ac.0-08 guntas in Survey No.894/5/2 is shown as "Government land"(ceiling patta) in prohibitory list. In order to get the said mistakes corrected, the petitioner submitted online application No.2200143238 dated 22.11.2022, but the same is not being considered and there is inordinate delay in acting upon the said application, as such, the petitioner is constrained to approach this Court.
3. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue, and perused the material available on record.
4. Learned Assistant Government Pleader for Revenue submitted that appropriate action will be taken on online application of the petitioner.
5. Recording the aforesaid submission of the learned Assistant Government Pleader for Revenue, this writ petition is disposed of directing the respondents to consider online application No.2200143238, dated 22.11.2022, submitted by the petitioner for 3 BVR,J W.P.No.26266_2023 passbook data correction in respect of the extent of the land being shown as Ac.1-00 instead of Ac.1-08 guntas in Survey No.894/5/1 situated at Molangur Village, Shankarapatnam Mandal, Karimnagar District, and for deletion of the land admeasuring Ac.0-08 guntas in Survey No.894/5/2, which is shown as 'Government lands' (ceiling patta), from the prohibitory list, by issuing notice to the concerned/interested persons and pass orders in accordance with law within a period of 45 days from the date of receipt of a copy of this order.
