WRIT PETITION No.26085 of 2023
ORDER:
This Writ Petition is filed seeking a direction to respondent No.3 to consider his representation dated 08.09.2023 for inclusion of his name in the seniority list for promotion to the post of L.F.L.H.M. or Primary School Head Master or School Assistant as per his seniority and merit and to pass such other order or orders.
2. Learned counsel for the petitioner submitted that on the earlier occasion when the petitioner was offered promotion, he has relinquished the same on medical grounds and on that ground, the name of the petitioner has not been included in the list of eligible candidates for promotion in 2023 and now he is seeking consideration of his case for promotion in the light of the judgment of the Division Bench of this Court in the case of G.Boyanna v. High Court of A.P. and another in W.P.No.24609 of 2007 dated 30.10.2008.
3. Learned Government Pleader for Services-I appearing for respondents No.1 to 4, is also heard.
4. Having regard to the fact that the petitioner is eligible for consideration for promotion according to his seniority and in view of the judgment of the Division Bench of this Court in the case 2 of G.Boyana v. High Court of A.P. and another, this Court deems it fit and proper to direct the respondents to consider the case of the petitioner and to dispose of the representation of the petitioner dated 08.09.2023 by entering his name in the seniority list and to consider him for promotion to the post of L.F.L.H.M. or School Assistant in accordance with law.
5. With the above directions, the Writ Petition is disposed of at the admission stage. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
