SECOND APPEAL No.1163 of 2010
JUDGMENT:
This Second Appeal is filed by the appellant - appellant - plaintiff No.1 against the judgment and decree dated 09.03.2010 passed in A.S.No.31 of 2008 by the I Additional District Judge, Khammam confirming the judgment and decree dated 12.12.2007 passed in O.S.No.204 of 2001 by the Principal Junior Civil Judge, Khammam.
2. When the matter came up for hearing on 01.09.2023, there was no representation by the learned counsel for the appellant. Accordingly, the matter was directed to be posted to 18.09.2023 under the caption 'for dismissal'. Even today also, there is no representation by the learned counsel for the appellant though the matter is posted under the caption 'for dismissal'. It appears that the appellant is not interested in prosecuting the matter.
3. As the appellant is not evincing any interest in proceeding with the matter, it is considered fit to dismiss the appeal.
4. Hence, the Second Appeal is dismissed for default. No order as to costs.
As a sequel, miscellaneous applications pending in this appeal if any, shall stand closed.
