SECOND APPEAL NO. 784 OF 2005
JUDGMENT:
Plaintiff has filed O.S. No. 27 of 1996 on the file of Senior Civil Judge, at Bodhan for declaration and half share of house and recovery of possession and it was decreed. The unsuccessful defendant preferred the appeal vide A.S. No. 29 of 2002 on the file of VII Addl. District and Sessions Judge at Nizamabad whereby the appeal suit was allowed by setting aside the judgment and decree passed by the trial Court. Against which the plaintiff preferred the present Second Appeal.
2. A perusal of the docket proceedings shows that the learned counsel for the appellant did not evince any interest to pursue the second appeal proceedings. On 18.08.2023 there was no representation on behalf of the learned counsel for the appellant in spite of posting the matter under the caption 'for dismissal'. No purpose would be served in continuing the Second Appeal.
3. Accordingly, the Second Appeal is dismissed for non- prosecution. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
