           SECOND APPEAL NO. 663 OF 2005

JUDGMENT:

Plaintiff has filed O.S. No. 8 of 1994 on the file of I Additional Subordinate Judge, Warangal, for recovery of amount was decreed by the trial Court and the appellate Court confirmed the judgment and decree of the trial Court vide A.S. No.54 of 1997 on the file of IV Additional District Judge, Warangal, against which the Second Appeal has been preferred.

2. A perusal of the docket proceedings shows that the learned counsel for the appellant did not evince any interest to pursue the second appeal proceedings. On 10.08.2023 there was no representation on behalf of the learned counsel for the appellant, in spite of posting the matter under the caption 'for dismissal'. He has not turned up today. No purpose would be served in continuing the Second Appeal.

3. Accordingly, the Second Appeal is dismissed for non- prosecution. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
