SECOND APPEAL NO. 721 OF 2005
JUDGMENT:
Plaintiff has filed O.S. No. 81 of 1994 on the file of Senior Civil Judge, at Nizamabad for recovery of money wherein it was dismissed. The unsuccessful plaintiff preferred the appeal vide A.S. No.23 of 1999 on the file of VI Addl. District and Sessions Judge at Nizamabad whereby the appeal suit was also dismissed confirming the judgment and decree passed by the trial Court. Against which the plaintiff preferred the present Second Appeal.
2. A perusal of the docket proceedings shows that the learned counsel for the appellant did not evince any interest to pursue the second appeal proceedings. On 14.08.2023 there was no representation on behalf of the learned counsel for the appellant in spite of posting the matter under the caption 'for dismissal', he has not turned up today. No purpose would be served in continuing the Second Appeal.
3. Accordingly, the Second Appeal is dismissed for non- prosecution. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
