               APPEAL SUIT NO. 438 OF 2008

JUDGMENT:

Plaintiffs filed O.S. No. 36 of 1993 on the file of Senior Civil Judge at Peddapalli for partition and separate possession and it was decreed. Against which the defendants preferred the present Appeal Suit before this Court.

2. A perusal of the docket proceedings shows that learned counsel for the appellants is no more. Notices sent to the parties have returned unserved. It is represented that learned counsel for the appellants is expired ten days back. In spite of sending the notices to the parties, they have not been served upon the parties. In these circumstances, no purpose would be served in continuing the Appeal Suit.

3. Accordingly, the Appeal Suit is dismissed. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
