SECOND APPEAL No.479 of 2010
JUDGMENT:
This second appeal is filed by the appellant-respondent-plaintiff against the judgment dated 13.10.2009 passed in A.S. No.339 of 2007 by the learned Chief Judge, City Civil Courts, Hyderabad, allowing the appeal by setting aside the judgment and decree dated 27.04.2004 passed in O.S. No.4697 of 1999 by the learned XIX Junior Civil Judge, City Civil Courts, Hyderabad.
2. When the matter was taken up for hearing on 19.08.2023, there was no representation by the learned counsel for the appellant as well as the learned counsel for the respondent. Hence, the matter was directed to be posted to 12.09.2023 under the caption 'for dismissal'. Even today also, there is no representation by the learned counsel for the appellant as well as learned counsel for the respondent, though the matter is posted for dismissal.
3. Hence, the second appeal is dismissed for default. No costs. As a sequel, miscellaneous applications, pending if any, shall stand closed.
