SECOND APPEAL No.120 of 2010
JUDGMENT:
This appeal is filed by the appellant against the judgment dated 01.08.2008 passed in A.S. No.249 of 2007 by the learned XIII Additional Chief Judge (FTC), City Civil Courts, Hyderabad, confirming the judgment and decree dated 19.12.2006 passed in O.S. No.1727 of 2001 by the learned I-Senior Civil Judge, City Civil Courts, Hyderabad.
2. When the matter was taken up for hearing on 11.08.2023, there was no representation by the learned counsel for the appellant as well as the learned counsel for the respondent. Hence, the matter was directed to be posted to 05.09.2023 under the caption 'for dismissal', and thereafter, it was posted to 12.09.2023. Even today also, there is no representation by the learned counsel for the appellant as well as learned counsel for the respondent, though the matter is posted for dismissal.
3. Hence, the second appeal is dismissed for default. No costs. As a sequel, miscellaneous applications, pending if any, shall stand closed.
