SECOND APPEAL NO.442 OF 2005
JUDGMENT:
This Second Appeal is filed against the Judgment and Decree dated 01.03.2005 in A.S.No.11 of 1997 passed by the learned III Additional District and Sessions Judge (F.T.C) Nizamabad, in which the Judgment and Decree, dated 22.01.1997 passed by the learned Prl. District Munsiff, Nizamabad was confirmed.
2. Learned counsel for the appellants as well as the learned counsel for the respondent is present
3. On 11.08.2023, there was no representation for the appellants and therefore, the matter was directed to be listed under the caption 'for dismissal'. Today, the learned counsel for the appellant is present and stated that he is not in touch with his clients/appellants and sought for time.
4. In fact the suit was filed for injunction and the same was decreed by the Trial Court and it was also confirmed by the first Appellate Court. Against the concurrent findings of both the courts, the present Second Appeal is filed. Therefore, no purpose is served in continuing the present appeal. 2
5. Accordingly, the Second Appeal is dismissed. No costs.
Pending miscellaneous petitions, if any, shall stand closed.
