ORDER:
Heard learned counsel for the petitioner, Sri.G.Praveen Kumar, Deputy Solicitor General of India appearing for respondent Nos.1 and 2.
2. The petitioner approached the Court seeking the prayer as follows:
"To issue an appropriate writ order or direction more in the nature of writ of mandamus the action of respondents more particularly that of respondent No.2 in refusing to issue passport in File No.HY8065525788523 dated 01.08.2023 for a reason that the 4th respondent submitted a verification report adversely holding petitioner involvement in Crime No.438/2021 U/s 341, 353, 506 IPC of P S Dundigal pending trial vide CC No.104/2023 and Crime No.464/2021 U/s 341, 353, & 506 IPC on the file of P.S Banjara Hills, pending trial as CC No.9411/2021 even in spite Petitioner oral reply dated 08.08.2023 to Letter seeking explanation vide Ref No.SCN/315406385/23 Dated 01.08.2023, explaining cogent reasons of such wrongful acquisition as well the involuntary inculpation of petitioner etc as being Illegal, Arbitrary, Un Constitutional, being violative of Articles 21 and 300A, against the Letter and spirit of Catena of Judgments rendered by this Honorable Court as well that of Honorable Supreme Court of India apart from being violative of principles of natural Justice and Fair play."

It is represented by the learned counsel for the petitioner and learned Counsel appearing on behalf of the respondent 2 WP_25116_2023 SN,J Nos.1 and 2 that the present writ petition is squarely covered by the order of this Court dated 07.02.2023 passed in W.P.No.3278 of 2023, hence, the writ petition could be disposed of in terms of the order of this Court dated 07.02.2023 passed in W.P.No.3278 of 2023.
4. Bringing the said submission of the learned counsel on record, the writ petition is disposed of directing the respondent No.2 to consider the application No.HY8065525788523 dated 01.07.2023 submitted by the petitioner seeking to issue passport without reference to the police report of respondent No.4, subject to the terms/conditions as stated in the order dated 07.02.2023 passed in W.P.No.3278 of 2023.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs.
