       At the time when the matter is taken up for hearing, it is submitted by

the learned counsel for the petitioner that the petitioner passed away and

hence nothing survives for adjudication in the appeal.

       The said submission is not disputed by the learned counsel for the

respondent.

Recording the above submission, the C.M.A. is accordingly dismissed as abated. No costs. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
