             WRIT PETITION NO.11957 OF 2010

ORDER:

The Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:

..."To issue a writ of Mandamus declaring the impugned action of the respondents in not considering the petitioners for appointment on contract basis or on regular basis in the posts created for newly commenced project i.e., Kakatiya Thermal Power Project under 4th respondent though the petitioners are working for the past 3 to 5 years and further action of the respondents in contemplating to fill up sanctioned vacancies on contract basis with all outsiders and land losers ignoring the contract labour who are already working i.e., petitioners herein as illegal, arbitrary and contrary to the Judgment of the Hon'ble Supreme Court and also contrary to G.O.Ms.No.98, dated 15.04.1986 and pass orders"..

2. This Court on 27.05.2010 granted interim direction in W.P.M.P.No.15073 of 2010 which reads as "Interim direction as sought for". Pursuant thereto, the respondents examined the petitioner and found that there is no eligibility and same was communicated to the petitioner. In view of the same, cause in the writ petition does not survive. 2

3. Accordingly, this Writ Petition is dismissed as infructuous. No order as to costs.

Miscellaneous applications, if any pending, shall stand closed.
