APPEAL SUIT No.150 of 2019
JUDGMENT:
This appeal is filed by the appellant aggrieved by the judgment and decree passed in O.S.No.1625 of 2008 dated 31.10.2018 by the learned IX Additional Senior Civil Judge at L.B.Nagar, Rangareddy District.
2. When the matter came up for hearing on 23.08.2023, there was no representation by the learned counsel for the appellant. Accordingly, the matter was directed to be posted to 04.09.2023 under the caption 'dismissal'. Even today also, there is no representation by the learned counsel for the appellants though the matter is posted under the caption 'for dismissal'.
3. The learned counsel for respondent No.1 also reported that papers were not served on them.
4. Hence, considering that there is no representation for the appellant though the matter is posted under the caption 'dismissal' and the submissions of the learned counsel for respondent No.1 that the counsel for the appellant had not served the papers on them, it is considered fit to dismiss the appeal.
5. Accordingly, the Appeal Suit is dismissed for default.
No order as to costs.
As a sequel, miscellaneous applications pending in this appeal, if any, shall stand closed.
