SECOND APPEAL No.802 of 2013
JUDGMENT:
This appeal is filed by the appellants - defendants against the judgment and decree passed in A.S.No.11 of 2012 dated 07.02.2013 by the Additional District Judge, Wanaparthy confirming the judgment and decree passed in O.S.44 of 2007 dated 16.08.2010 by the Senior Civil Judge, Wanaparthy, Mahaboobnagar District.
2. When the matter came up for hearing on 17.08.2023 and 28.08.2023, there was no representation by the learned counsel for the appellants. Accordingly, the matter was directed to be posted to 04.09.2023 under the caption 'for dismissal'. Even today also, there is no representation by the learned counsel for the appellants though the matter is posted under the caption 'for dismissal'. It appears that the appellants are not interested in prosecuting the matter.
3. As the appellants are not evincing any interest in proceeding with the matter, it is considered fit to dismiss the appeal.
4. Accordingly, the Second Appeal is dismissed for default.
No order as to costs.
As a sequel, miscellaneous applications pending in this appeal, if any, shall stand closed.
