SECOND APPEAL No.479 of 2004
JUDGMENT:
1. The present appeal has been filed against the judgment and decree dated 22.04.2002 passed in A.S.No.194 of 2000 on the file of XII Additional Chief Judge, City Civil Court, Hyderabad.
2. There is no representation for the appellant.
3. Inspite of service of summons respondent counsel did not appear.
4. On the last date of hearing, when the matter was taken up for hearing, there was no representation for the appellant, and therefore, the matter was directed to be posted to today under the caption 'for dismissal'. In spite of matter being listed today under the caption 'for dismissal', there is no representation for the appellant. This shows that the appellant is not evinced any interest in prosecuting the case. Therefore, this appeal is liable to be dismissed for non-prosecution.
5. Accordingly, this appeal is dismissed for non-prosecution. There shall be no order as to costs. Miscellaneous petitions, pending if any, shall stand closed.
