JUDGMENT:
1. The present appeal has been filed aggrieved by the judgment and decree dated 06.01.2004 passed in A.S.No.21 of 2002, on the file of the II Additional District Judge, F.T.C-I, Khammam.
2. Learned counsel Sri M.V.B.S.Narsimha Anudeep representing learned counsel for the appellant submits that the sole appellant died 10 years back.
3. Learned counsel for the respondent Nos.1 to 4 present.
4. As seen from the record, so far, legal representatives of the sole appellant are not brought on record. Therefore, this appeal is liable to be dismissed as abated.
5. Accordingly, this appeal is dismissed as abated. There shall be no order as to costs. Miscellaneous petitions, pending if any, shall stand closed.
