JUDGMENT:
1. The present appeal has been filed aggrieved by the judgment and decree dated 24.10.2002 passed in O.S.No.41 of 1996, on the file of Senior Civil Judge, Karimnagar.
2. Learned counsel for the respondent Nos.2 and 3 present.
3. It is brought to the notice of the Court that the counsel for the appellant is no more. Notice ordered to the appellant but returned with an endorsement that no such addressee in the house number.
4. This matter is of the year 2008 and the appellant was not residing in the said address, as such, his presence cannot be secured. No purpose would be served in continuing the appeal. Therefore, this appeal is liable to be dismissed for non-prosecution.
5. Accordingly, this appeal is dismissed for non-prosecution. There shall be no order as to costs. Miscellaneous petitions, pending if any, shall stand closed.
