SECOND APPEAL NO. 595 OF 2006
JUDGMENT:
Plaintiff filed O.S.No.11 of 2002 on the file of Senior Civil Judge, Siddipet, for recovery of money. The trial Court decreed the suit. The unsuccessful defendants preferred appeal vide A.S.No.24 of 2006 wherein the appellate Court had dismissed the appeal, against which the second appeal has been filed.
2. A perusal of the docket proceedings shows that the learned counsel for the appellants did not evince any interest to pursue the second appeal proceedings. On 06.10.2023, as there was no representation on behalf of the learned counsel for the appellants, the matter was directed to be listed under the caption 'for dismissal'. Even today also, there is no representation for the appellants. No purpose would be served in continuing the Second Appeal.
3. Accordingly, the Second Appeal is dismissed for non- prosecution. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
