     Appellants herein are Accused Nos.3 and 5 in

S.C.No.49 of 2017. Vide impugned judgment dated

26-06-2018

in S.C.No.49 of 2017 learned Spl. Sessions Judge for SC/ST (POA) Act - cum - VII Addl. District and Sessions Judge, Ranga Reddy district at L.B. Nagar, convicted the appellants herein for the offences punishable under Sections 302 and 201 r/w.34 of IPC and Section 3(2)(v) of SC/ST (POA) Amendment Act, 2016.

2. Challenging the said judgment, the appellants herein filed Criminal Appeal No.2159 of 2018. Therefore, they cannot file 2nd appeal vide Crl.A.No.3031 of 2018, challenging the very same judgment.

3. In view of the aforesaid controversy, this Court directed learned counsel appearing for the appellants to get instructions from the appellants / A-3 and A-5. 2

4. Even then, learned counsel appearing for the appellants failed to get instructions. Appellants herein / Accused Nos.3 and 5 cannot file two appeals challenging the very same judgment. Therefore, this Criminal Appeal is liable to be dismissed.

5. Accordingly, this Criminal Appeal is dismissed.

As a sequel, the miscellaneous petitions, if any, pending in the Criminal Appeal shall stand closed.
