JUDGMENT:
Learned counsel appearing for the appellant filed memo on behalf of the appellant and submitted that the dispute between the parties was settled out of the Court through compromise. The Memorandum of Compromise Petition filed under Order 23 R3 C.P.C by both the parties and the Memorandum of Compromise recorded on 14.09.2023 and seeks permission to withdraw the Second Appeal.
2. Accordingly, permission is granted as sought for. The Second Appeal is dismissed as withdrawn.
3. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
