2. This intra Court appeal has been filed against an interim order dated 26.04.2023 passed by the learned Single Judge in W.P.No.27348 of 2016 by which the writ petitioners have been permitted to occupy the subject premises and a direction has been issued to the Greater Hyderabad Municipal Corporation to provide the basic amenities.
3. We have heard learned counsel for the parties.
4. The basis for grant of the interim order dated 26.04.2023 is the order of stay dated 23.06.2017 passed in 2 W.P.No.20621 of 2017 by which the order of cancellation of building permission has been suspended.
5. After arguing the matter to some extent, learned counsel for the appellants submits that he be granted liberty to seek vacation of the interim order dated 23.06.2017 passed in W.P.No.20621 of 2017 and thereafter be granted liberty to seek modification of the interim order dated 26.04.2023.
6. In view of the aforesaid as well as taking into account the fact that the order dated 26.04.2023 has already been upheld by a Division Bench of this Court in W.A.No.559 of 2023, dated 06.06.2023, the writ appeal is disposed of in terms of the liberty as prayed for.
Miscellaneous applications pending, if any, shall stand closed. However, there shall be no order as to costs.
