WRIT PETITION No.20977 of 2021
ORDER :
Petitioner in this writ petition has challenged the action of respondents in proposing to recover an amount of Rs.30,09,000/- from his retirement benefits.
2. Heard Sri Srinivasa Rao Madiraju, learned counsel for the petitioner, learned Assistant Government Pleader for Services-I appearing for respondent Nos.1, 3 and 4 and Sri K.Balakrishna, learned Standing Counsel for respondent No.2.
3. When the matter is taken up, it is submitted by the learned counsel for the petitioner that the subject matter of this writ petition is covered to be disposed of in terms of the earlier order of this Court dated 22.08.2023 in W.P.No.26181 of 2021, whereby, this Court, by relying on the judgment of the Hon'ble Supreme Court in State of Punjab and others vs. Rafiq Masih(White Washer) 1, has disposed of the writ petition directing the respondents therein to repay the amount recovered from the pensionary benefits of the 1 2015(4)SCC 334 2 JS, J W.P.No.20977 of 2021 petitioner. He seeks for disposal of the present writ petition also in terms of the said order.
4. The learned counsel for respondents have expressed no objection for the same.
5. In view of the above submissions and for the reasons recorded in the order dated 22.08.2023 in W.P.No.26181 of 2021, this writ petition is disposed of directing the respondents not to recover any amounts from the retirement benefits/pension of the petitioner and they shall refund if any such amounts are already recovered from the petitioner, within a period of three (03) months from the date of receipt of a copy of this order. No costs.
Pending miscellaneous applications, if any, shall stand closed.
