WRIT PETITION No.3289 of 2010
ORDER:
The writ petitioner challenges the action of the respondent in not issuing order of appointment to the petitioner as Junior Lineman, and seeks a consequential direction to the respondent to issue order of appointment to the petitioner, in pursuance of the judgment of this Court in Writ Appeal No.1434 of 2008 and batch dated 10.11.2008 with effect from the date on which others were given the orders of appointment, and by granting all consequential benefits.
Heard learned counsel for the petitioner, and learned counsel for the respondent.
The 2nd respondent-Superintending Engineer filed an Additional Counter Affidavit, wherein it is stated at paragraph 6 as under:
"6. It is further submitted that, in view of the subsequent development of appointment of the petitioner as Junior Lineman on yearly contract basis and he is continuing as Lineman at Jangaon Division, the grievance of the petitioner has been redressed, as such the writ petition is liable to be dismissed."
Learned counsel for the respondent, at the hearing, reiterated the stand taken in the additional counter affidavit of 2nd respondent that the grievance of the petitioner has been redressed.
Accordingly, the writ petition is disposed of. Interlocutory applications, if any pending, shall also stand disposed of in consequence. No order as to costs.
