WRIT PETITION No.26475 of 2023
ORDER:
This Writ Petition is filed seeking a direction to the respondents to consider the representation of the petitioner dated 12.02.2023 for change of local cadre on spouse grounds and to pass such other order or orders.
2. Learned counsel for the petitioner submitted that the petitioner's husband is an employee in Defence. The petitioner has filed an appeal dated 12.02.2023 for change of local cadre on spouse grounds and the same has not been considered so far.
3. Learned counsel for the petitioner has placed reliance upon the judgment of this Court in I.A.No.1 of 2022 in W.P.No.1007 of 2022 and batch dated 29.04.2022, wherein, this Court had directed the respondents to consider the case of the petitioner where her spouse is working in Central Government Organizations. A copy of the said order is placed before this Court.
4. Learned Government Pleader for Services-I appearing for respondents No.1 to 5, submitted that petitioner's Appeal is pending before the respondents and the application of the 2 petitioner would be considered by the concerned authorities in accordance with law.
5. In view of the same, this Writ Petition is disposed of directing respondent No.5 to pass appropriate orders on the appeal of the petitioner considering the judgment of this Court in I.A.No.1 of 2022 in W.P.No.1007 of 2022 and batch dated 29.04.2022 within a period of four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
