JUDGMENT:
When the matter came up for hearing on 24.08.2023 there was no representation for the appellant, therefore the matter was directed to be listed to 14.09.2023 under the caption 'for dismissal". On 21.09.2023, learned counsel for the appellant seeks time to get instructions. In spite of it, today also there is no representation for the appellant. Therefore, this Court has no option except to dismiss the appeal for non-prosecution/default.
2. Accordingly, the Appeal is dismissed for non- prosecution/default. No order as to costs.
3. Pending miscellaneous applications, if any, shall stand dismissed.
