SECOND APPEAL No.427 of 2009
JUDGMENT:
This Second Appeal is filed by the appellants-appellants- defendants against the judgment dated 18.03.2009 passed in A.S. No.3 of 2005 by the learned II-Additional District Court (F.T.C.), Mahabubnagar, confirming the judgment and decree dated 31.12.2004 passed in O.S. No.37 of 2003 by the learned Senior Civil Judge, Wanaparthy.
2. When the matter is taken up for hearing, learned counsel for the appellants sought permission of this Court to withdraw the second appeal as the parties had settled the matter out of court.
3. Permission is accorded.
4. Accordingly, the appeal is dismissed as withdrawn. No costs. As a sequel, miscellaneous applications, pending if any, shall stand closed.
