SECOND APPEAL No.1253 of 2010
JUDGMENT:
This Second Appeal is filed by the appellant - defendant aggrieved by the judgment passed in A.S.No.113 of 2006 dated 31.08.2006 by the I Additional Chief Judge, City Civil Court, Secunderabad, confirming the judgment and decree passed in O.S.No.1316 of 2004 dated 03.04.2006 by the I Junior Civil Judge, City Civil Court, Secunderabad.
2. When the matter came up for hearing on 20.09.2023, there was no representation by either counsel. Accordingly, the matter was directed to be posted to 12.10.2023 under the caption 'for dismissal'. Even today also, there is no representation by the learned counsel for the appellant though the matter is posted under the caption 'for dismissal'. It appears that the appellant is not interested in prosecuting the matter.
3. As the appellant is not evincing any interest in proceeding with the matter, it is considered fit to dismiss the appeal.
4. Hence, the Second Appeal is dismissed for default. No order as to costs.
As a sequel, miscellaneous applications pending in this appeal if any, shall stand closed.
