              WRIT PETITION No.47686 of 2018

ORDER:

Heard learned counsel for the petitioner and learned counsel for the respondents.

2. This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"....to issue a Writ Order or Order more in the nature of Writ of Mandamus declaring impugned action of the respondents in not regularizing the petitioners service though he rendered more than 33 years of uninterrupted service as a Sweeper against clear vacancy under the control of the respondents and even not paying time scale attached to the said post and being paid only paulrty wages is illegal, arbitrary, discriminatory and contrary to the G.O.Ms. No.212, dt:22-04-1994 and the dicta laid down by the Apex Court in B.Srinivasulu's case and also recent judgment in W.P.No.33936 of 2011 and batch dt 02.05.2018 and consequently seeking mandamus to the respondents herein to regularize her services from the date of completion of 5 years ie., 16.05.1991 with all consequential benefits and pass such other order or orders...."

3. During the pendency of the Writ Petition, the respondent authorities have issued Proceedings vide C.No.1785/B6/95-2022, dated:30.08.2023 stated as follows:
"....The respondents in W.P.No.21396 of 2009 B.Laxmi and others are not fulfilling the conditions stipulated in G.O.Ms.No.112, dated:23-07.1997, and there are no sanctioned posts of sweepers in Nalgonda district. Hence their services cannot be regularized...."
4. In view of the same, the cause in the writ petition does not survive for adjudication.

5. Recording the above submission, the writ petition is closed. However, the petitioner is given liberty to challenge the proceedings dated.30.08.2023, if she is aggrieved.

Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
