SECOND APPEAL NO.1184 OF 2017
JUDGMENT :
Learned counsel for the appellant on record, would submit that he has no instructions from his client in spite of his best efforts. Further, though he tried to contact the counsel before the Court below to get the instructions, it was in vain.
2. In the light of the above, it appears that the appellant is not interested to prosecute the matter vigilantly and diligently any more. This appeal is preferred against the concurrent findings of the Trial Court as well as the first appellate Court. Therefore, this Court feels that there is no necessity to issue notice to the appellant asking him to come to the Court. Accordingly, this appeal is liable to be dismissed for non-prosecution.
3. Resultantly, this appeal is dismissed for non- prosecution.
Pending miscellaneous application, if any, shall stand closed.
