JUDGMENT:
This Second Appeal is filed by the appellant-appellant-defendant aggrieved by the judgment and decree dated 05.10.2009 passed in A.S.No.396 of 2007 on the file of the Chief Judge, City Civil Court, Hyderabad, confirming the judgment and decree dated 30.03.2007 passed in O.S.No.16521 of 2003 on the file of the VII Junior Civil Judge, City Civil Court, Hyderabad.
2. When the matter came up for hearing on 05.09.2023 and 29.09.2023, there is no representation by the learned counsel for the appellant. The matter was posted to 05.10.2023 under the caption 'for dismissal'. Even today also, there is no representation by the learned counsel for the appellant though the matter is posted under the caption 'for dismissal'. It appears that the appellant is not evincing any interest in proceeding with the matter.
3. In the result, the Second Appeal is dismissed for default. No costs.
