           WRIT PETITION No.25216 of 2023
ORDER:

The case of the petitioners is that their grandfather was the original owner and possessor of total extent of Ac.10.39½ guntas of land comprising in various survey numbers situated at Vadaparthy Village, Bhongir Mandal, Yadadribhongir District and subsequently a suit for partition, vide O.S.No.316 of 1984, was instituted by petitioner Nos.1 to 3 along with the father of petitioner Nos.4 to 6 on the file of Principal District Munsif, Bhongir, in respect of the said property, which was decreed vide judgment and decree dated 17.10.1992. Questioning the said judgment and decree, father of respondent No.4 filed A.S.No.26 of 1992 on the file of Subordinate Judge, Bhongir, which was dismissed on 30.09.1997 against which S.A.No.960 of 1996 was filed before this Court and the same was dismissed on 13.06.2007 confirming the judgment and decree passed in O.S.No.316 of 1984. Thereafter, the property was partitioned among the parties vide final decree proceedings dated 24.11.2008. The 2 contention of the petitioner is that even after the property being divided with metes and bounds, respondent No.4 with a mala fide intention is disputing the boundaries and localisation of the subject property. His grievance is that at the instance of respondent No.4, respondent No.3 is interfering with the civil disputes between the petitioner and respondent No.4 and forcing the petitioner to enter into compromise/settlement as per the terms dictated by respondent No.4.

2. Learned Assistant Government Pleader for Home, on written instructions, submits that acting on the complaints submitted by the petitioner as well as respondent No.4, cases have been registered, vide Crime No.315 of 2023 and Crime No.316 of 2023 and the said cases are pending for investigation.

3. In view of the said submission, the writ petition is disposed of directing respondent No.3 not to interfere with the civil disputes between the petitioner and respondent No.4 in any manner. However, the respondents police are 3 at liberty to proceed with the investigation in Crime No.315 of 2023 and Crime No.316 of 2023 in accordance with law.

Pending miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
