JUDGMENT:
1. Today when the matter is taken up for hearing Sri K.V.L.Jayasimha, the learned Counsel for the appellant on record submitted that he has given up his Vakalath long back and therefore he has no instructions on behalf of the appellant.
2. Recording the aforementioned submission, the appeal is dismissed for Non-prosecution/default. No order as to costs.
3. Pending miscellaneous applications, if any, in this appeal shall stand closed.
