THE HONOURABLE SRI JUSTICE K.SURENDER
CRIMINAL PETITION No.11431 OF 2023
O R D E R:
The petitioner is aggrieved by the Order dated 31.10.2023 passed in CRL.M.P.No.1160 of 2023 in Crime No.05/RCT/ACB/NZB/2022 by the learned Special Judge for trial of SPE and ACB Cases, Karimnagar directing the petitioner to give voice samples of two accused.
02. Accused No.1 is before this Court.
03. Learned counsel for the petitioner would submit that directing to give voice samples is in violation of Article 20 (3) of the Constitution of India which provides protection from self- implication.
04. The said ground cannot be accepted in view of Judgment of Honourable Supreme Court in Ritesh Sinha v. State of Uttar Pradesh 1 wherein it was held that directing a person to give voice samples will not be in violation of Article 20 (3) of the Constitution of India and will not amount to self- implication.
1 (2019) 8 SCC 1
05. In view of the above Judgment of Honourable Supreme Court, this Court is not inclined to interfere with the Order dated 31.10.2023 passed in CRL.M.P.No.1160 of 2023 in Crime No.05/RCT/ACB/NZB/2022 by the learned Special Judge for trial of SPE and ACB Cases, Karimnagar.
06. Accordingly, this Criminal Petition is dismissed. There shall be no order as to costs.
The Miscellaneous applications pending, if any, shall stand closed.
