WRIT PETITION No.31775 of 2023
ORDER:
This Writ Petition is filed seeking a direction to the respondents to grant notional service to the petitioner from 21.01.2002 in the cadre of School Assistant (Maths) on par with the 1st batch of DSC-2001 candidates and to pass such other order or orders.
2. In spite of making the above prayer in the Writ Petition, learned counsel for the petitioner submitted that he is limiting his prayer only to a direction to the respondents to consider and dispose of the representation submitted by the petitioner on 15.09.2023 in terms of judgment of this Court in similar matter i.e., in W.P.No.36811 of 2013.
3. Learned Government Pleader for Services-I appearing for respondents, is also heard.
4. In view of the fact that the only prayer of the petitioner is to consider his representation dated 15.09.2023 in the light of the judgment of this Court in W.P.No.36811 of 2013 dated 16.04.2018, this Court deems it fit and proper to permit the petitioner to submit a fresh representation to the respondents making reference to all the 2 PMD,J W.P.No.31775 OF 2023 judgments that he is relying upon and on receipt of such representation, the respondents are directed to consider the same and pass appropriate orders thereon within a period of six (06) weeks from the date of receipt of copy of this order.
5. With the above directions, this Writ Petition is disposed of at the admission stage. There shall be no order as to costs.
Miscellaneous applications, if any pending, shall also stand closed.
