SECOND APPEAL No.1416 of 2005
J U D G M E N T:
This second appeal is filed against the Judgment and Decree dated 27.07.2005 in A.S.No.14 of 1999 passed by the 2nd Additional District Judge, Adilabad, confirming the judgment and decree dated 01.03.1999 in O.S No.55 of 1993 on the file of Junior Civil Judge, Adilabad.
2. The suit for injunction filed by the appellant- plaintiff herein vide O.S.No.55 of 1993, was dismissed by the trial Court, against which the present Second Appeal is filed.
3. On 01.11.2023, there was no representation on behalf of the learned Counsel for the appellant, as such the matter was directed to be listed under the caption 'for dismissal' on 01.11.2023.
4. Even today, when the matter is taken up for hearing, there is no representation on behalf of the learned counsel for the appellant. Hence, no purpose would be served in continuing the present appeal. 2
5. Accordingly, the appeal suit is dismissed for non- prosecution. No order as to costs.
As a sequel, miscellaneous petitions, pending if any, shall stand closed.
