WRIT PETITION No. 33572 of 2015
ORDER:
The present Writ Petition is filed seeking the following relief:-
"to issue an appropriate writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the seizure of the stocks of the petitioner consequently issued 6A Case No.A7/254/CS/2014, dated 8.5.2015 issued by the 2nd respondent to confiscate the seized stocks of 105 Qlts. Rice valued Rs.1,57, 500/- is null and void without any power or authority under law".
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies appearing on behalf of respondents.
3. During the course of hearing, learned counsel for the petitioner fairly submits that the issue raised in this Writ Petition is squarely covered by the judgment of this Court in W.P.No.40429 of 2017 and batch, dated 02.12.2020, and the same is not disputed by the learned Assistant Government Pleader for Civil Supplies.
4. In view of the above, following the aforesaid judgment of this Court in W.P.No.40429 of 2017 and batch, 2 dated 02.12.2020, in terms thereof, the writ petition is allowed. No costs.
Pending miscellaneous applications, if any, shall stand closed.
