APPEAL SUIT No.765 of 2009
JUDGMENT:
This Appeal Suit is filed against the Judgment and Decree dated 29.06.2009 in O.S.No.6 of 2006 passed by the learned III-Additional District Judge, Karimnagar.
2. The suit vide O.S.No.6 of 2006 was filed by the appellant/plaintiff for recovery of amount of Rs.13,60,000/- against the respondents/defendants, but the same was dismissed by the trial Court. Aggrieved by the said Judgment, preferred the present appeal.
3. As the learned Counsel for the appellant is no more, notice was ordered to him, but it was returned with an endorsement "Door Locked" and returned to the sender. Though it was represented that Sri M.Kiran Reddy, learned Counsel intended to file Vakalat on behalf of the appellant, so far he has not filed Vakalat and the whereabouts of the appellant herein is not known and notice sent to him was not served, as such no purpose would be served in continuing the appeal. 2
4. Accordingly, the present appeal suit is dismissed. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
