CRIMINAL PETITION No.10777 OF 2023
ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (for short 'Cr.P.C.') by the petitioner - accused No.1 to quash the proceedings against him in C.C.No.71 of 2015 on the file of the IV Additional Chief Metropolitan Magistrate, Hyderabad for the offences under Sections 120(B), 406, 417, 418, 420, 421, 422, 426 of IPC.
2. Heard learned counsel for the petitioner and Sri S.Ganesh, learned Assistant Public Prosecutor for respondent No.1 - State.
3. The learned counsel for the petitioner submitted that the respondent No.2 lodged a complaint against the petitioner alleging that he had committed theft of blank signed cheque and filed a complaint by misusing the same. He further submitted that the petitioner filed a complaint against the respondent No.2 under Section 138 of the Negotiable Instruments Act (for short 'NI Act') and the same resulted in conviction. The respondent had not filed any appeal against the said judgment but, the petitioner himself challenged the said judgment to enhance the compensation amount and the same was partly allowed.
Dr.GRR,J Crl.P.No.10777_2023 2 He further submitted that the trial in C.C.No.71 of 2015 was almost completed except recording the evidence of the Investigating Officer and the matter was pending for the past one year.

Considering the facts and circumstances of the case and that the matter before the trial Court is more than 12 years old, this Court is not inclined to interfere with the proceedings against the petitioner. However, the trial Court is directed to dispose of the matter as expeditiously as possible, preferably within a period of one month from the date of receipt of a copy of this Order.
5. With the above direction, the criminal petition is disposed of. Pending miscellaneous applications, if any, shall stand closed.
