JUDGMENT: (per Hon'ble Sri Justice B.Prakash Rao) It appears that this matter underwent several adjournments at the request of the learned counsel appearing on either side. On 07.10.2010, when this matter was called both in the morning and in the afternoon sessions, none appeared for the appellants, hence, the matter was directed to be listed after Dasara Vacation, 2010 under the caption "for Dismissal". Even today, when the matter was taken up for hearing, the learned counsel for the appellants sought further adjournment.
Having regard to the fact that the matter has already undergone number of adjournments, we are not inclined to grant any further adjournments.
Hence, the appeal is dismissed for non-prosecution. No order as to costs.
