COMMON JUDGMENT:
None appears for the appellants. Perused the proceedings
dated 05.01.2023 and 23.03.2023. On both the dates, there was no
representation on behalf of the appellants. Learned counsel for the
respondent present and represented that half of the suit schedule
property is already sold out and the Appeal Suit is filed assailing the judgment and decree in a suit for specific performance. Appellants are not evincing any interest. Having regard to the proceedings dated 05.01.2023 and also the submissions made by learned counsel for the respondents, in the absence of any representation on behalf of appellants, since the suit is listed today under the caption 'for dismissal', I find no merit to adjourn the matter. Accordingly, I.A.No.1 of 2021 and the Appeal Suit are dismissed for default for non-prosecution. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
