                WRIT PETITION NO.28005 OF 2008

ORDER:

This writ petition is filed to declare the action of the respondents in not passing the award under Section 28-A of the Land Acquisition Act, re-determining the compensation in pursuance of the Judgment and Decree in A.S.No.225/1995 dated 23.12.2003 for the acquired lands admeasuring Ac.4.00 guntas in survey Nos.105, 127 to 129, 141/2, 144, 249 and 133 situated at Somidi Village, Hanamkonda Mandal, Warangal District as illegal, arbitrary and consequently direct the respondents to pass award re-determine the compensation under Section 28-A of the Land Acquisition Act.

Heard Mr.J.Venkateswara, learned counsel for the petitioner and learned Government Pleader for Land Acquisition.

No counter affidavit has been filed by the respondents, however, learned Government Pleader for Land Acquisition on instructions submitted that the application submitted by the petitioner under Section 28-A of Land Acquisition Act, 1894 is pending consideration and the same is being processed by respondent No.2. The said process is likely to take some more time.

In the light of the above, as the request of the petitioner for passing an award under Section 28-A of Land Acquisition is pending consideration before respondent No.2 and also taking into consideration the long lapse of time in passing orders on the said application submitted by the petitioner under Section 28-A, the Writ Petition is disposed of, directing respondent No.2 to pass an award under Section 28-A considering the application submitted by the petitioner within a period of three (03) months from the date of receipt of copy of this order.

There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed.
